Terms and Conditions
These terms govern the use of HyperLocal by customers, shops and riders in Pakistan. Separate sections apply to each; the general section applies to everyone. By creating an account you accept the version shown here.
This is version 1.0 of the document as accepted at registration. It is written in plain English and is being reviewed by Pakistani legal counsel before public launch; the numbered clauses will not change meaning without a new version, which every account must accept again.
1. General
- 1.1HyperLocal is a marketplace. Shops sell goods to customers; riders deliver them as independent contractors. HyperLocal is not the seller and not the carrier.
- 1.2You must be at least 18 to hold a shop or rider account and to buy age-restricted goods.
- 1.3Every account is tied to one Pakistani mobile number and, for shops and riders, to a verified identity (CNIC). You are responsible for what happens on your account.
- 1.4All prices are in Pakistani rupees. Every fee is shown before you commit to it.
- 1.5We may change these terms. Material changes create a new version, which you must accept before transacting again.
2. Customer terms
- 2.1Payment. Every order is prepaid by card or mobile wallet. Your card is held, or your wallet charged, the moment you choose a rider's bid. Cash on delivery is not offered.
- 2.2Cancellation. Free until you choose a rider. After that and before the shop starts preparing, a slot fee (Rs 50 at launch) goes to the rider. Once preparation has started you may be charged the goods — in full for perishable items, half otherwise — and the delivery fee.
- 2.3Failed delivery. If you cannot be reached at the address after the rider has called and waited the time shown in the app, the delivery counts as failed and the charges for a late cancellation apply.
- 2.4Returns and refunds. Wrong, missing, damaged or expired goods must be reported from the order within the window shown on the receipt. Refunds go back to the original card or wallet. Perishables cannot be returned unless faulty on arrival.
- 2.5Prohibited conduct. Abusive behaviour towards shops or riders, false reports, and repeated cancellations lead to warnings, restrictions and, ultimately, account closure.
- 2.6Disputes. Disputes are decided from the evidence chain — packing, collection and handover photos, codes, GPS traces and messages — under the liability rules published in the app.
- 2.7Liability. HyperLocal's liability for goods is capped per order at the amount disclosed in the app and excludes indirect losses.
- 2.8Data. Your phone number, addresses and order history are used to run the service, as described in the Privacy Policy.
3. Shop terms
- 3.1Fees. Without a subscription, 3 % of the goods value of each delivered order is deducted at settlement. With an active subscription the per-order fee is zero. The customer's platform fee and processing charges are never taken from your goods.
- 3.2Settlement. Earnings clear 24 hours after delivery and pay out weekly to your verified payout account, subject to a minimum and the transfer charge published in the app.
- 3.3Confirmation. You must answer every request within the response window (3 minutes at launch). Unanswered requests are declined automatically and count as a fault.
- 3.4Cancellation and strikes. Cancelling after the customer has paid refunds the customer in full and charges the rider's compensation to your account. Faults accumulate as strikes; repeated strikes restrict and then suspend the account.
- 3.5Price parity. You list the prices you charge over the counter. HyperLocal may verify parity, including through the point of sale, and may suspend a shop that inflates online prices.
- 3.6Legality and licences. You warrant that everything you list may be sold lawfully, that regulated categories are covered by valid licences, and that nothing on the prohibited-goods list is listed.
- 3.7Goods liability. You are liable for wrong, missing, damaged or expired goods as evidenced by the packing photo, and you must accept returns under the return rules for your category.
- 3.8Data. You may use customer contact details only to fulfil the order.
4. Rider terms
- 4.1Independent contractor. You deliver as an independent contractor, using your own motorcycle and phone, at the times you choose. Nothing in these terms creates employment.
- 4.2Bids are binding. A bid the customer accepts is a contract to deliver for that fee. Releasing an accepted job puts it back on the board and counts as a fault.
- 4.3Delivery obligations. Collect against the shop's code, hand over against the customer's code, and take the photographs the app asks for at collection and handover.
- 4.4Goods in your possession. You are responsible for the goods from collection to handover as evidenced by the photographs.
- 4.5Abandonment. Leaving a job unfinished without releasing it is a serious fault and may lead to suspension and recovery of the loss.
- 4.6Payouts and deductions. Without a subscription, 10 % of each delivery fee is deducted at settlement. Earnings clear after 24 hours and pay out daily to your verified account, subject to the minimum and transfer charge published in the app.
- 4.7Strikes. Faults accumulate as strikes; repeated strikes restrict and then suspend the account.
- 4.8Insurance. HyperLocal does not insure you or your motorcycle. You are responsible for your own third-party cover; the app records whether you hold it.
- 4.9Location. While on duty your location is tracked and shown to the customer during a delivery, and kept for six months as dispute evidence.
5. Prohibited goods policy
- 5.1Nothing may be listed that is illegal to sell or deliver in Pakistan, including narcotics, weapons, counterfeit goods and unregistered medicines.
- 5.2Prescription medicines may be listed only by a licensed pharmacy and delivered only against an uploaded prescription.
- 5.3Age-restricted goods may be sold only to verified adults and are checked at handover.
- 5.4Listings that match the prohibited-goods register are removed automatically and the shop is warned; repeat offences close the account.
